The academic scandal at UNC didn't result in punishment because the majority of students involved weren't athletes. Regular students benefited from it too.

Typically, wins/titles are not “forfeited” in NCAA punishments. They are, instead, “vacated.” So the Team(s) that lost or finished 2nd do not get a ‘win credit’ or a title.

North Carolina's position was that the NCAA lacked jurisdiction on academic issues. Instead this fell to accrediting agencies. As previously mentioned the general student body could take the course and some did. North Carolina was willing to litigate the issue the NCAA wasn't.
